Legal Policies & Terms of Service

These policies govern all services provided by Forward Visions Photography. By booking or engaging our services you agree to the terms below.

1. Booking & Payment

1.1 How to Book

All sessions are booked through forwardvisionsphotography.pixieset.com. A booking is confirmed only upon receipt of a signed contract and the required deposit.

1.2 Deposit

A non-refundable deposit is due once a shoot date is confirmed through consultation. The deposit is applied toward your total and is forfeited upon cancellation regardless of cause.

1.3 Remaining Balance

Remaining balance is due no later than 48 hours before your session unless stated otherwise in your contract.

1.4 Pricing

All prices are in USD. The quoted price at booking is honored for confirmed sessions. Quotes are valid for 14 days.

2. Cancellation & Rescheduling

2.1 Cancellation

All deposits are non-refundable. Cancellations require a minimum of 7 days written notice to booking@forwardvisionsphotography.com. If the session involves a studio rental, the studio’s cancellation policy applies and may require more notice — in that case the studio’s timeline takes precedence. Less than 7 days notice may incur additional charges for non-recoverable costs.

2.2 Rescheduling

One complimentary reschedule is available upon request and at the sole discretion of Forward Visions Photography. A second request or any not approved requires a new deposit.

2.3 Photographer Cancellation

Forward Visions Photography may cancel in the event of illness, emergency, or circumstances beyond reasonable control. A full refund will be issued or the client may reschedule at no charge.

3. Copyright & Intellectual Property

3.1 Ownership

All photographs are the exclusive intellectual property of Forward Visions Photography under U.S. copyright law. Payment does not transfer copyright.

3.2 Client License

Upon full payment, clients receive a limited non-exclusive license for personal non-commercial use: personal printing, personal social media with credit to @Carey_Clutch, and personal digital communications.

3.3 Commercial Use

Commercial use requires a separate written license before use begins.

3.4 Prohibited Uses

Without written consent: selling or sublicensing images; altering images beyond color adjustments; using images in AI training datasets; removing watermarks or metadata.

3.5 Portfolio Rights

Forward Visions Photography retains the right to display delivered images in its portfolio and marketing unless a written non-display agreement is signed before the session.

4. Image Delivery

4.1 Timeline

Standard delivery within 14 business days. Events up to 21 business days. Rush delivery available for an additional fee.

4.2 Method

All images delivered via private Pixieset gallery to the email provided at booking.

4.3 Gallery Access

Galleries accessible for 90 days from delivery. Clients are responsible for downloading all files before expiry.

4.4 Number of Images

Number of delivered images is at the discretion of Forward Visions Photography. Specific quantities are only binding if stated in a written contract.

4.5 RAW Files

RAW files are available as a paid add-on, requested before gallery delivery. Delivered as-is, unedited. Purchase does not transfer copyright. Clients may not edit RAW files and attribute results to Forward Visions Photography.

5. Privacy Policy

5.1 Data Storage

Forward Visions Photography does not independently store client personal data, payment information, or booking details on its own servers or devices. All such data is collected and stored by Pixieset, Inc. under their own Privacy Policy (pixieset.com/legal/privacy).

5.2 Communications

By booking a session you consent to receive emails related to your booking and session. You may opt out of marketing communications at any time by emailing booking@forwardvisionsphotography.com.

5.3 Third-Party Services

Forward Visions Photography uses Pixieset (booking, galleries, payments), Google Workspace (email), and Instagram/Meta (portfolio). Each is governed by their own privacy policies.

5.4 Children’s Privacy

Sessions involving minors require written consent from a parent or legal guardian before the session.

6. Model Release & Image Consent

6.1 Implied Consent

By engaging Forward Visions Photography, adult subjects (18+) provide implicit consent for portfolio and marketing use as described in Section 3.5.

6.2 Opt-Out

Subjects who do not wish to appear publicly must provide written notice before the session date. Verbal requests made during or after the session are not binding.

6.3 Minors

Sessions involving individuals under 18 require a signed minor consent and model release form from a parent or legal guardian before the session. Images of minors will not be used publicly without explicit written consent.

6.4 Events

At events and group sessions, individuals present are subject to incidental capture. Forward Visions Photography will not prominently feature identifiable individuals in commercial use without their consent.

7. Limitation of Liability

7.1 Equipment & Technical Failure

In the event of equipment failure, data loss, or other technical issues beyond our control, liability of Forward Visions Photography is limited to a full refund of fees paid for that session. We are not liable for indirect, consequential, or special damages.

7.2 Artistic Dissatisfaction

Photography is a creative and subjective art form. Forward Visions Photography does not issue refunds on the basis of artistic dissatisfaction. Review our portfolio thoroughly before booking.

7.3 Maximum Liability

Maximum liability shall not exceed the total fees paid for the session in question.

7.4 Force Majeure

Forward Visions Photography is not liable for failure to perform due to circumstances beyond reasonable control including acts of God, natural disasters, pandemic, governmental orders, or civil unrest. Reasonable efforts to reschedule or refund will be made.

8. Session Conduct

8.1 Timeliness

Sessions begin at the scheduled time. Late arrivals reduce available session time. If the client is more than 30 minutes late without notice, the session may be cancelled and the deposit forfeited.

8.2 Location Permits

Clients are responsible for securing required permits for private or restricted locations. Forward Visions Photography assumes no liability for denied access or permit violations.

8.3 Conduct on Set

Forward Visions Photography reserves the right to terminate a session if any party engages in abusive, threatening, or discriminatory behavior. All fees paid will be forfeited.

9. Dispute Resolution & Governing Law

Both parties agree to first attempt good-faith resolution by contacting booking@forwardvisionsphotography.com. These terms are governed by the laws of the State of Georgia. Any legal action shall be brought in the appropriate courts of Cobb County, Georgia. Unresolved disputes will proceed to binding arbitration under AAA rules before litigation. Claims must be brought individually — no class actions.

10. Policy Changes

Forward Visions Photography may modify these policies at any time. Updates will be posted at forwardvisionsphotography.com/legal with a revised effective date. Continued use of our services constitutes acceptance of revised terms.
